Terms and Conditions of Kasper Transportation and Kasper Bus Lines

Introduction

Welcome to Kasper! We're excited to have you on board and committed to ensuring a safe and enjoyable journey. By purchasing a ticket or boarding a bus operated by 2470566 Ontario Inc., operating as Kasper Transportation and Kasper Bus Lines (hereinafter "Kasper"), you agree to the following terms and conditions.

Booking and Ticketing

a. Tickets purchased are only valid for the date, time, and route specified. b. Tickets are non-transferable and must be presented before boarding. c. Fares and schedules are subject to change without prior notice. d. Printed and Digital Tickets are accepted.

Fare Classes

a. Standard Fare – can only be purchased online at www.gokasper.com, our app, or customer service centre.

  • Baggage: 1 checked bag up to 50 lbs and 1 carry-on small bag. Additional bag(s) are $25 each
  • Rebooking: Sales are final; no rebooking.
  • Cancellation: Sales are final; no refunds.
  • Points: Earn $1 spent with us equals 1 point, with each point valued at .10 cents (1/10) of the dollar.

b. Freedom Fare – can only be purchased online at www.gokasper.com, our app, or customer service centre.

  • Baggage: 2 checked bags up to 50 lbs each and 1 carry-on small bag. Additional bag(s) are $15 each
  • Rebooking: Free of charge.
  • Cancellation: Refundable.
  • Points: Earn $1 spent with us equals 1.15 points, with each point valued at .10 cents (1/10) of the dollar.

c. Busbud Fare – can only be purchased at www.Busbud.com Website or App.

  • Baggage: 1 checked bag up to 50 lbs and 1 carry-on small bag.
  • Rebooking: Sales are final; no rebooking.
  • Cancellation: Sales are final; no refunds.
  • Additional bag(s) are $25 each

Currency Denomination

All prices, fees, charges, and any monetary transactions mentioned or implied in these terms and conditions, or related to the services provided by Kasper, are denominated in Canadian Dollars (CAD). Any and all financial transactions with Kasper will be processed in Canadian Dollars.

Schedule Time Zone Information for the Website and App

All departure and arrival times displayed on our website and app are in the local time of the pick-up location unless otherwise specified. Please note that we operate across two primary time zones: Central Time Zone (CT) and Eastern Standard Time Zone (EST). Passengers are advised to be mindful of the local time zone of their departure location when planning their travels and arriving for their scheduled service. If in doubt please call our customer service.

Passenger Boarding Responsibility

It is the sole responsibility of the passenger to arrive at the designated pick-up point ahead of the scheduled departure time and actively approach the bus driver to confirm their presence for the journey. While our drivers make every effort to ensure all passengers are accounted for, we do not guarantee that they will call out for or search for passengers, especially at third-party pick-up locations such as McDonald's, Tim Hortons, gas stations, or convenience stores. We strive to maintain a respectful relationship with these establishments and do not wish to disturb their regular business operations. Failure to present oneself on time and make one's presence known to the driver may result in missing the service, and Kasper Transportation shall not be liable for any consequences or costs associated with such missed departures.

Pricing and Tax Information

a. Mobile Application: All prices displayed on our mobile application are inclusive of all applicable taxes. The price you see is the final price you will be charged.

b. Website: Prices displayed on our website are exclusive of taxes. Applicable taxes will be added to the listed price at the time of purchase, and the final amount will be displayed before you confirm your purchase. It is the responsibility of the customer to review and understand the total amount payable, including taxes, before finalizing any transaction.

Conduct Onboard

a. Passengers must adhere to all instructions provided by Kasper staff.

b. Unruly or disruptive behavior may result in removal from the bus.

c. Smoking, consumption of alcohol, and use of illegal substances are prohibited onboard.

d. Not all of our vehicles have equal amenities or facilities that passengers can use. Most of our vehicles do not have restrooms or equal-performing WIFI, snacks, or seating comfort.

Restricted Items in Personal Baggage

(exceptions subjected to prior approval )

  1. Dangerous or Hazardous Materials: This includes but is not limited to:
    • Explosives, fireworks, or flares.
    • Flammable liquids or solids.
    • Corrosive substances, such as strong acids or bases.
    • Toxic or infectious substances.
    • Radioactive materials.
    • Compressed gases, including aerosol cans with flammable propellants.
  2. Weapons:
    • Guns, firearms, and ammunition. Only if permitted with a valid RPAL or PAL and permission to transport. Must be checked in the proper container or case.
    • Sharp objects, including large knives, scissors, or any cutting tools. Must be stored in checked luggage.
    • Martial arts weapons and self-defense items (e.g., pepper spray, mace). Must be stored in checked luggage in proper packaging.
  3. Large Items: Any items that cannot fit securely in the baggage compartment or that might obstruct aisles or emergency exits.
  4. Illegal Substances: Drugs or other substances which are illegal in any jurisdictions where the bus will be traveling.
  5. Alcoholic Beverages: Especially if the consumption onboard is not permitted.
  6. Perishable Goods: Such as raw meat, fish, or dairy products unless securely packed to prevent leakage and odors.
  7. Fragile Items: Passengers should be advised against carrying fragile items, or if they do, it should be at their own risk.
  8. Live Animals or Insects: Except service animals that are permitted by law.
  9. Valuables: It's usually advised that passengers keep valuables such as jewelry, large sums of money, important documents, etc., with them at all times rather than in checked baggage.
  10. Odorous Materials: Items that produce a strong odor, even if non-hazardous, which might be disruptive or discomfort to other passengers.
  11. Electronic Items: Batteries, especially lithium-ion batteries, should be safely stored, and it's typically recommended that they remain in carry-on baggage.

Right to Inspect Baggage

Kasper Transportation reserves the right to inspect and search any passenger's baggage at our discretion to ensure the safety and security of all passengers, staff, and equipment. This may be done without prior notice to the passenger. By purchasing a ticket and boarding our buses, passengers consent to such inspections. Failure to comply or permit an inspection when requested may result in the denial of boarding or continued transport without any liability to Kasper Transportation.

Limitation of Liability

a. Kasper shall not be liable for delays due to traffic, weather, or other factors beyond its control.

b. Kasper’s liability for any loss, damage, or injury shall not exceed the ticket price.

Accessibility

a. Buses are not designed to accommodate persons who are wheelchair-bound. We can accommodate only folding mobility devices on our services at the moment. None of our buses are equipped with an elevator platform to accommodate passengers with reduced mobility or those in a wheelchair. If you require storage for foldable wheel-chair in storage compartment, please make your reservation at least 48 hours in advance by calling 1.855.566.2378.

Privacy Policy

a. Personal information collected is for reservation and ticketing purposes only and will not be sold or shared with third parties, except as required by law.

Personal Hygiene Clause

  1. Purpose: The promotion of a comfortable and safe environment for all passengers and staff is paramount. An integral aspect of this comfort and safety is the assurance of acceptable personal hygiene standards amongst all individuals utilizing our services.

  2. Standards of Personal Hygiene: All passengers are expected to maintain a basic level of personal cleanliness to ensure the comfort and health of everyone on board. This includes, but is not limited to:

    a. Being free from strong and offensive body odors.
    b. Ensuring hands and face are visibly clean. c. Wear clean clothing which is free from strong odors or heavy soilage.

  3. Enforcement: Kasper Transportation staff reserves the right to deny boarding or service to any individual who does not meet the above personal hygiene standards. Such a decision will be made with discretion, sensitivity, and respect, keeping the comfort and safety of all passengers in mind.

  4. Refunds & Rebooking: If a passenger is denied boarding due to failure to meet the personal hygiene standards outlined in this clause: a. They may be entitled to rebook their journey once they can ensure their personal hygiene meets our requirements. b. Refunds in these situations will be considered on a case-by-case basis.

  5. Disputes: Passengers who feel they have been unfairly treated under this clause are encouraged to contact Kasper Transportation customer service for resolution.

WiFi Service

Wifi speeds may vary depending on how many passangers are using the service at the same time and what is being downloaded or streamed. We try our best to not retrict type of content being used, it may affect the speeds you will expierance. Some of our older vehicles only have 4G, while our newest ones will have 5G network connections or Starlink mobile dish capable very fast speeds. Congestion on the network will effect the peformance of the connection.

  1. Provision of Service: Kasper provides complimentary WiFi services to passengers aboard its buses. This service is intended for general web browsing, email, and light streaming.
  2. Acceptable Use: Users agree not to use the WiFi service for:
    • Downloading or uploading large files, which may slow down the service for other users.
    • Accessing or distributing unlawful or malicious content.
    • Conducting any activity that is harmful, harassing, or offensive.
    • Any commercial purposes, including advertising or solicitation.
  3. No Guarantee of Continuous Service: While we strive to offer reliable and consistent WiFi service, Kasper does not guarantee that the WiFi will be uninterrupted, timely, secure, or error-free. Factors such as the bus's location, network congestion, and maintenance can affect connectivity.
  4. Data Limitations: Kasper reserves the right to impose data limitations or throttle speeds to ensure equitable access for all passengers.
  5. Privacy & Security: While using our WiFi service, passengers are responsible for their own security and privacy measures, such as VPNs and firewalls. Kasper is not responsible for any breaches of privacy or data that occur while using the onboard WiFi service.
  6. Discretion to Deny Access: Kasper reserves the right to deny or restrict access to the WiFi service to any individual who violates these terms, abuses the service, or engages in any activity deemed inappropriate by Kasper.
  7. Changes to WiFi Service: Kasper may at its discretion and without notice, modify, suspend, or terminate the WiFi service.

Unaccompanied Minors Policy

  • Minors under the age of 12 are not permitted to travel unaccompanied by an adult on any Kasper Transportation service.
  • Minors aged between 12 to 17 may travel unaccompanied but are required to present a consent form signed by a parent or guardian prior to boarding.
  • Kasper Transportation assumes no responsibility for the direct supervision of unaccompanied minors during travel.

Child/Youth Travelers

  • under the age of 8 or 18-36 kg (40-80 lb) or under 145 cm (4 ft 9 in) tall require a booster seat,
  • toddler 9-18 kg (20-40 lb) requires a forward-facing child car seat,
  • baby/infant up to 9 kg (20 lb) requires a rear-facing child car seat. Please make prior arrangements before the day of travel to accommodate any passengers that require a booster seat or a child car seat.

Lost and Found Policy

  • Items left behind by passengers and subsequently found by Kasper staff will be retained for a period of 30 days.
  • Passengers may report lost items to Kasper Transportation customer service for assistance in retrieval.
  • Kasper Transportation is not responsible for any items that are lost or damaged during travel. The collection of found items is the sole responsibility of the owner.
  • We can return the items to the passengers by picking them up from our depot, they can be mailed at the customer's expense.

Service Animals Policy

  • Recognized service animals are permitted onboard Kasper Transportation services with the presentation of valid documentation.
  • Non-service animals or pets must be securely placed in an appropriate and safe carrier for the entirety of their journey.
  • Valid documentation should ensure the animal has actually done the training by a proper training center and the animal is trained to serve as a service animal, any liability resulting from falsification of this documentation will lead to our legal team seeking criminal and or financial consequences.

Emergency Procedures

  • Should there be an emergency during transit, passengers are required to follow instructions as directed by Kasper staff immediately.
  • Emergency exits are clearly identified on all Kasper vehicles and should be utilized only under appropriate circumstances or when directed.
  • Passengers are strongly advised to dress appropriately for the prevailing weather conditions. In extremely cold conditions, such as temperatures reaching -40°C, passengers should be attired sufficiently to survive for an extended period before help arrives. Light attire in such a severe cold can pose serious risks to health and safety.
  • Conversely, during warmer months, passengers should ensure they can adjust their clothing comfortably in case of air conditioning malfunctions or prolonged periods of being stranded. It's essential to be prepared for all eventualities to ensure your well-being and comfort.
  • All buses meet safety regulations, and may have emergency hammers, all buses will have First Aid Kits.

Loyalty Program Details

  • Points acquired through ticket purchases with Kasper Transportation can be redeemed for future travel discounts, merchandise, etc.
  • Such points are non-transferable and do not expire at this time, subject to change without notice.
    Promotions and Discounts Policy
  • All promotional offers and discounts provided by Kasper Transportation are subject to availability and may have specific terms and conditions that passengers should adhere to.
  • A single promotional offer or discount is applicable per booking. Combining multiple offers or discounts is not permitted.

Governing Law

These terms and conditions shall be governed by the laws of Ontario, Canada.

Changes to Terms and Conditions

Kasper reserves the right to modify these terms and conditions at any time.

Severability Clause

If any provision of these terms and conditions is determined to be invalid or unenforceable under any applicable statute or rule of law, such provision is to that extent to be deemed omitted, and the balance of the terms and conditions shall remain enforceable.

Refusal of Service

Kasper Transportation reserves the right to refuse service to anyone for legitimate business reasons, in accordance with applicable local, provincial, and federal laws or regulations, including but not limited to the prevention of potential threats, safety risks, or disturbances to other passengers.

Indemnification

Passengers agree to indemnify and hold harmless Kasper Transportation and its employees from and against all losses, damages, liabilities, claims, actions, judgments, costs, and attorney’s fees resulting from or arising out of their negligence or misconduct during the use of Kasper's services.

Feedback and Reviews

Passengers may be prompted or asked for feedback or reviews about their journey. By providing feedback, you grant Kasper the right to use your feedback and reviews for its business purposes, including but not limited to, marketing and advertising. Personal information will be kept confidential.

Dispute Resolution

In the event of any dispute arising out of these terms and conditions, parties agree to first attempt to resolve the matter amicably through mutual discussions. If the dispute is not resolved within 30 days of such discussions, either party may resort to legal proceedings.

Final Provisions

These terms and conditions constitute the entire agreement between Kasper Transportation and the passenger, superseding any prior or contemporaneous agreements or understandings, oral or written, and may not be amended or modified except in writing signed by both parties.
